Most of our personal injury cases are ‘No Win No Fee’. This allows us to thoroughly investigate your claim without financial risk to you. The best thing to do is to speak to us about your case and we can discuss funding with you. We do not offer legal aid. We fund claims in the following ways:
When you make a ‘no win no fee claim’ with us you will not have to pay anything upfront. You will only need to pay an agreed percentage of your damages if your case is successful. The percentage is determined at the outset of your claim and will be agreed with you before starting your claim.
Most cases are advanced with us on a “no win no fee” basis. This means that you won’t pay us anything unless your case is successful, with some exceptions such a fraud, dishonesty or refused to follow reasonable advice. The exceptions will be set out to you in your agreement with us at the outset of your claim.
If your claim is unsuccessful the No Win No Fee Agreement means there is no financial risk to you and you will not pay anything unless you are dishonest in what you have told us, fraud or have refused to follow our reasonable advice.
In some cases, we offer “After The Event” Insurance rather than ‘No Win No Fee’ to ensure your case has the best chance of success. This involves taking out an insurance policy known as “After The Event”, or “ATE” on your behalf. The policy covers our legal fees and costs if your case is unsuccessful. The policy allows us to access skilled and complex experts that may be necessary for your claim.
We work with various insurance providers common across the Scottish legal profession that offer ATE Insurance. There are no up-front costs, but an agreed percentage is deducted following the success of your claim. Should your claim be unsuccessful, there is no payment due by you unless there has been fraud, dishonesty or refused to follow reasonable advice.
Legal Expenses Insurance can be included or bought as an optional extra in your insurance policies such as home and car. It is designed to cover your legal costs for making or defending certain types of claim.
This type of legal expenses insurance is often called “Before the Event”, because you would have taken out the cover before anything has happened.
It may be possible to use legal expenses insurance to fund your personal injury claim, but this will depend on the terms of your policy and the claims limit. We can look at your policy and advise you on the terms as well as act for you. You do not need to accept the legal representation that is allocated through your policy. We are often able to act.
