This case is known as the “Challenger” judgement which was heard in the Supreme Court in 2013 and made it clear that, if there is negligence in the preparations for battle that results in harm in the course of the engagement, injured service personnel have the right to make a claim against the Ministry of Defence. However, the judgement did protect commanders and the Crown from decisions made in the ‘heat’ of the moment in combat even if negligent.
